Актуальность исследования обусловлена предстоящим вступлением в силу с 1 сентября 2026 г. поправок в Федеральный закон № 86-ФЗ «О государственном регулировании в области генно-инженерной деятельности», которые вводят понятие «генетические данные человека» и устанавливают ограничения на их трансграничную передачу. В этой связи представляется необходимым изучить зарубежный опыт, в частности Китая, обладающего развитой системой правового регулирования в данной сфере, для возможного использования его положительных практик в Российской Федерации.</p></sec><sec><title>Методы</title><p>Методы. В ходе исследования использовались общенаучные методы (анализ, синтез, обобщение), а также специально-юридические методы: сравнительно-правовой, формально-юридический и догматический. Проведен анализ доктринальных источников российских и китайских авторов, нормативных правовых актов КНР, в том числе законов «О биобезопасности» и «О защите персональных данных», а также Положения об управлении человеческими генетическими ресурсами и иных подзаконных актов. Дополнительно изучены эмпирические данные о динамике административного лицензирования в 2021–2024 гг.</p></sec><sec><title>Результаты</title><p>Результаты. Выявлено, что китайская модель регулирования обращения генетических данных базируется на принципе государственного суверенитета, который пронизывает все уровни нормативного регулирования. Законодательство использует двойственную конструкцию – «материалы человеческих генетических ресурсов» и «информация о человеческих генетических ресурсах», каждая из которых имеет собственный правовой режим. Генетические данные одновременно подпадают под действие законодательства о биобезопасности, о персональных данных и о медицинских больших данных, что создает многослойную систему требований. Обращение ресурсов осуществляется преимущественно в разрешительном порядке, а трансграничная передача и доступ иностранных субъектов подвергаются строжайшему контролю. Система ответственности включает административные штрафы, уголовное преследование и дисквалификацию. При этом принятые в 2023–2025 гг. подзаконные акты демонстрируют тенденцию к рационализации регулирования (сужение сферы лицензирования, упрощение процедур для клинических исследований).</p></sec><sec><title>Заключение</title><p>Заключение. Китайский опыт может быть полезен для Российской Федерации при формировании комплексного законодательства о генетических технологиях. Предлагается принять базовый федеральный закон, который бы объединил нормы о защите прав личности и обеспечении национальной безопасности, установил четкие критерии для трансграничной передачи генетических данных и предусмотрел эффективные механизмы контроля и ответственности.</p></sec></abstract><trans-abstract xml:lang="en"><sec><title>Objective</title><p>Objective. This article analyzes the approaches to the legal regulation of genetic information and human genetic data in the People’s Republic of China. The study is motivated by the forthcoming entry into force, on September 1, 2026, of amendments to Federal Law No. 86-FZ “On State Regulation in the Field of Genetic Engineering Activities”, which introduce the concept of human genetic data and establish restrictions on their cross-border transfer. This makes it necessary to examine foreign experience, particularly that of China, which has established a system of legal regulation in this area, in order to assess the applicability of its positive practices in the Russian Federation.</p></sec><sec><title>Methods</title><p>Methods. The research employed both general research (analysis, synthesis, generalization) and special legal methods, such as comparative legal, formal legal, and dogmatic analysis. A review of doctrinal sources by Russian and Chinese authors, as well as regulatory legal acts of the PRC, including the Biosafety Law, the Personal Information Protection Law, the Regulations on the Management of Human Genetic Resources, and other subordinate legislation was conducted. Additionally, empirical data on the dynamics of administrative licensing in 2021–2024 were examined.</p></sec><sec><title>Results</title><p>Results. The Chinese model of genetic data regulation is based on the principle of state sovereignty, which permeates all levels of normative regulation. The legislation employs a dual structure of “human genetic resource materials” and “human genetic resource information,” each of which has its own legal regime. Genetic data simultaneously fall under the scope of biosafety legislation, personal data protection legislation, and medical big data legislation, thus creating a multi-layered system of requirements. The circulation of resources is carried out predominantly under a permissive (authorization) procedure, while cross-border transfer and access by foreign entities are subject to the strictest control. The liability system includes administrative fines, criminal prosecution, and disqualification. At the same time, the subordinate regulations adopted in 2023–2025 reflect a trend towards rationalization of regulation (narrowing the scope of licensing, simplifying procedures for clinical trials).</p></sec><sec><title>Conclusion</title><p>Conclusion. China’s experience may be useful for the Russian Federation in developing a comprehensive legislation framework on genetic technologies. The need to adopt a basic federal law that would combine norms on the protection of indi-vidual rights and ensuring national security, establish clear criteria for the cross-border transfer of genetic data, and provide effective mechanisms for control and liability is argued.</p></sec></trans-abstract><kwd-group xml:lang="ru"><kwd>генетическая информация</kwd><kwd>генетические данные</kwd><kwd>человеческие генетические ресурсы</kwd><kwd>правовое регулирование</kwd><kwd>Китайская Народная Республика</kwd><kwd>биобезопасность</kwd><kwd>трансграничная передача данных</kwd></kwd-group><kwd-group xml:lang="en"><kwd>genetic information</kwd><kwd>genetic data</kwd><kwd>human genetic resources</kwd><kwd>legal regulation</kwd><kwd>China</kwd><kwd>biosafety</kwd><kwd>cross-border data transfer</kwd></kwd-group></article-meta></front><back><ref-list><title>References</title><ref id="cit1"><label>1</label><citation-alternatives><mixed-citation xml:lang="ru">Берг, Л.Н., Владимирова, Д.С., Лисаченко, А.В., Павлов, И.С., Пучков, О.А., Радостева, Ю.В., ...
