В условиях пандемий, глобальной тенденции старения населения, кризисов систем здравоохранения, в том числе в развитых государствах, возрастает роль профилактики в борьбе с заболеваемостью. Все больше внимания в политике здравоохранения разных стран уделяется вопросам превентивной медицины и пропаганды здорового образа жизни. Разрабатываются новые подходы к концепции общественного здравоохранения, формируется новая модель здравоохранения, ориентированная на использование цифровых алгоритмов для обработки данных о здоровье населения, которые могут стать эффективным инструментом для разработки мероприятий по поддержанию общепопуляционного здоровья и продвижения политики здоровьесбережения с акцентом на благополучие и здоровое старение.

Целью настоящего исследования является анализ социальных аспектов внедрения механизмов превентивного здравоохранения в правовом преломлении. Превентивная медицина в нашей стране не является абсолютно новым явлением: профилактика здоровья в виде вакцинации, закаливания, систематических физических упражнений была ключевым здравоохранительным трендом в советское время; диспансеризации населения и ранней диагностике заболеваемости уделяется значительное внимание в настоящее время. Между тем в современных технологических условиях превентивная медицина приобретает новые возможности и новые черты, не только опосредованные классическими для медицины профилактическими мероприятиями в виде диспансеризации и иммунопрофилактики с использованием новейших технологий, но и ориентированные на новые прогностические подходы в здравоохранении. Данные процессы требуют юридического осмысления.

Превентивная медицина достаточно персонализирована, поскольку зиждется на физиологических, биологических, анатомических, психических, поведенческих особенностях конкретного человека, хотя в основе может лежать популяционная ориентированность, основанная на общности географических, социальных, генетических, демографических характеристик населения конкретной территории. Таким образом, складывается новая парадигма здравоохранения, которая направлена на обеспечение всестороннего медицинского подхода к каждому с использованием новейших технологий в здравоохранении.

В этих целях крайне важно обеспечить адекватное законодательное регулирование, отвечающее не только современным технологическим трендам, но и направленное на защиту тех прав и свобод в сфере охраны здоровья, которые гарантированы каждому Основным Законом.

Результат исследования заключается в выявлении основных особенностей развития превентивной медицины в нашей стране в правовом контексте.

In the context of pandemic threats, global population aging, and recurring health system crises, including those affecting developed countries, the importance of disease prevention is steadily increasing. Health policies worldwide are placing greater emphasis on preventive medicine and the promotion of healthy lifestyles. New approaches to the concept of public health are emerging, along with the development of healthcare models that rely on digital algorithms for processing public health data. These technologies can facilitate the development of measures to improve population health and promote health-saving policies with an emphasis on wellbeing and healthy aging.

In this study, the author sets out to analyze the social aspects of implementing preventive healthcare mechanisms from the legal perspective. Preventive medicine is not a new phenomenon in Russia. Thus, during the Soviet era, preventive healthcare measures in the form of vaccination, hardening of the body, and systematic physical exercise constituted the cornerstone of public health policy. Today, significant attention is paid to population health screening and the early detection of diseases. Meanwhile, contemporary preventive healthcare relies on advanced digital technologies, thus acquiring new dimensions beyond traditional measures such as medical examinations and immunoprophylaxis. This gives rise to new legal challenges that require analysis.

Preventive medicine is inherently personalized, since it takes into account an individual’s physiological, biological, anatomical, mental, and behavioral characteristics. At the same time, preventive strategies may also be population-based, addressing the shared geographical, social, genetic, and demographic characteristics of specific communities. This contributes to the emergence of a new healthcare paradigm that aims to deliver comprehensive, personalized medical care through the application of advanced technologies. Its successful implementation requires an appropriate legislative regulation that not only keeps pace with technological innovation but also safeguards the constitutional rights and freedoms associated with health protection.

As a result of the study, the main features that characterize the development of preventive medicine in Russia from the legal perspective were identified.
